Oddly enough – technically, if Metromart really did press charges part of the disclosure would be what they were hunting for. That is at least a trade secret of a competitor which would mean that Metromart would have to disclose that they had received this outside of an agreement – which actually IS illegal under IP law. So, I would guess it probably isn’t worth it, and Metromart should just settle.

Since I presume the formula was trademarked, Metro-mart can be counter sued and likely drop the charges and forced to return the formula.
