    Reagan made 232 recess appointments, GHW Bush 78, Clinton 139, W. Bush 171.I guess those nominated by Clinton were unconstitutional?

    There is nothing in this cartoon that is factually correct, other than that these 3 judges were Republican appointees. Personally, I’d like to get rid of both recess appointments, and pro forma sessions of Congress. Both are ways to game the system.Having said that, the difference in this case is that the Senate was in session, albeit a pro forma one. No other president making recess appointments has ever done so during a pro forma session. This is the reason why this particular incident was ruled unconstitutional. I would also point out that this particular tool was wielded by Harry Reid to prevent Bush from making recess appointments on several occasions – and even though I think Bush was a bad president, he honored the pro forma sessions.

    The judges threw out Obama’s appointees despite a century of precedent & laws that say a President has the right to fill vacancies in government with the people of his choosing. These these judges are usurping Executive powers & hiding behind claims that the Founding Fathers wouldn’t like it. Strange that they’ve only arrived at that position now….

    Yes. They would do anything to return to the White Male controlled world of the 50’s. Women make the coffee, Blacks stay out of sight and go to the back of the bus, Gays are imprisoned or killed with impunity, etc. But it’s too late. You cannot unwrite history.
