Any of the scenarios the defense has proposed as a defense for Floyd’s death would have still, in most places in the USA, been a cause to arrest and convict.
From my uninformed perspective, it is very obvious that the key bit is the DURATION of the neck-on-throat hold. All the rest of it is hand waving (on the part of the defense) or piling on (on the part of the prosecution). There’s no possible way he could have NOT known that he was (running a real risk of killing) the guy by just keeping him down in that manner for that long. And he had easily available options that would have been just as effective, much less dangerous, and if George had died when restrained that way there would have been no possible way to prosecute him for murder.
Seems to me that the issue is reducible to these two conditions: Did George Floyd die while Derek Chauvin “restrained” him? Would George Floyd have died last May 25th if he hadn’t been “restrained” by Derek Chauvin? Floyd was a sick man could have died unexpectedly. But it seems clear that Chauvin was the efficient cause of Floyd’s death and Floyd was the material cause. (What’s efficient cause? See Aristotle’s “Physics”, the four causes: material, efficient, formal, and final.)

Yes, this all could have been a regrettable mistake. Floyd was already headed for the grave. Unfortunately, Chauvin sped things up.

No matter what other factors contributed to Floyd’s death Chauvin had NO BUSINESS kneeling on his neck for more than 9 minutes, if at all.
