At least the Orson Welles broadcast announced that it was a radio play at the beginning and end. It was only the people who tuned in while it was going on who (supposedly) mistook it for actual news.
If the aliens didn’t listen to the full broadcast before deciding to mount an expedition, they have only themselves to blame.

You’re a cartoon “alien” from a society so advanced it could travel god-knows how many light years — 80, say? — to a distant planet where radio broadcasts in hundreds of alien languages have been radiating into space for maybe a century, and after having successfully translated one of them and interpreted it to be an account of invasion of one planet by another — which, by the way, has no evidence of life on it — and you’re pissed off at us now because it turns out you couldn’t distinguish fact from fiction?!
