There is an equal protection clause in the final sentence of section one of the 14th amendment. “No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty or property without due process of law; nor deny to any person within its jurisdiction the equal protection of the law.”
Eno is becoming more and more stupid and unlikeable. Or have I just not been paying attention? But I will defend his right to say anything he wants regardless of how stupid arrogant and and nasty.
To be fully accurate, what gives the political cartoonist “the right to print this stuff” is his “unalienable rights to life, liberty, and the pursuit of happiness”. As long as the expression of his rights does not violate the rights of others, he is free to do (or say or publish or blog) whatever he wishes.
What the Bill of Rights (and thus the amended Constitution) did was to single out several areas of rights that historically had been the particular targets of government violation of rights. So the Constitution does not bestow rights, it only recognizes and defends them. Or at least that’s how it should be–again.
The most relevant Amendments are the 9th and 10th, which affirm that there are more rights than are enumerated in the first eight. Beware of people who think you only have rights the government grants you, because it is their intention to take rights away from you.
Right to Privacy: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. (4th amendment)
stebon, were you issuing such a dire warning when GWB was busy shreddding the Constitution (you know, “just a piece of paper” to him) and grabbing power left and right?
