The judge and jury thing is all the wrong way round. The judge has the legal knowledge but is dependent for a verdict frtom a group that has little, whereas those representing the public and are therefore most affected by crime, have no say in the punishment handed out.

I don’t know how they do it in Oz, but in the U.S., judges below the federal court level are often elected, thus ensuring that if there is an especially qualified candidate there’s still a good chance you’ll end up with someone who doesn’t know a boot from a bucket.

At least in Virginia, the jury does recommend sentence in a criminal trial.
