The Miranda Act is one of the worse things to happen in this country. It only requires the police to inform you of your rights if they are arresting you. They should be required to tell everyone they have a right to remain silent and that everything you say will be used against you.
The above comment is totally bogus. The police officer is obligated by law to advise a subject of their Miranda Rights only if he intends to “interrogate” the individual. If the officer is affecting an “arrest only” no Miranda warning is necessary. If the subject voluntarily (without questioning) makes an incriminating statement that’s on him. Retired DA Investigator.
