The number is set by Congress. There is nothing in the Constitution regarding the number of justices. We’ve had as few as 5 and as many as 10.
Even with nine, SCOTUS often does go into overtime, WAY overtime….
It’s high time we made SC rulings invalid unless unanimous.
In such a case, whatever the case, it can’t be overturned. Only a majority can overturn; a tie lets the judgement stand unchanged.
