If so, the case is set for trial before a petit jury or judge. Grand jury proceedings are not open to the public, with only prosecutors and, occasionally, a judge being present. If the grand jury decides whether there is reasonable cause to believe that there has been criminal conduct, an indictment issues. If a trial is held, it will before a petit jury or a judge, depending on the nature and level of the offense and whether the defendant waives its right to a jury trial.
