Morning TRIBE*! Not realizing SHE WHO MUST BE OBEYED was sick in bed (men are real perceptive about these subtle things), I varied my normal cut flowers Friday with an Eatable Arrangement which was not met with joy and appreciation. . All those lovely chocolate covered fruits, artfully arranged were next to me while I read all weekend. QUESTION? Do I run out and buy another with something left on it, or do I Man UP? Dear, the cat did it!

Good afternoon, tribe! Doesn’t Jennifer’s dog resemble Wink? It has been a busy morning for me, trying to get everything to balance & ready to wrap up my mom’s estate. Finally found the formula error I’d made on the Excel worksheet that was throwing me off. I’m hoping that within the next week or two, I’ll get it all wrapped up!

Thanks, Sojo! I’ve expressed Shakespeare’s sentiments about lawyers a few times in this process. It has been a real hassle, and it should have been a breeze. My folks did legal work ahead of time, and none of the heirs are fighting. I’d hate to think what it would have been like if they were, or if I wasn’t as good at keeping records.

My mom spent 18 months getting my uncle’s estate squared away. No will. So if anyone out there doesn’t have one or has been putting it off, there are several websites that’ll do one for about $70. save a lot of hassles.

Hi, Grog! RwB - I don’t know how much $ my parents spent to get a living trust set up, will, POA, etc. but even with all that, it has been a hassle. I can’t imagine how bad it could have been! And that was with having zero debts when she died. I do think it is extremely important to have Power of Attorney & Executor designated before the need arises. Those 2+ years after her stroke and before she died would have been extremely difficult if I hadn’t already been designated. However, I think LegalZoom or forms from someplace like OfficeMax would be a lot more economical than going through a lawyer to get the needed paperwork done. At least for POA, etc. Doing a living trust probably needs a personal lawyer, but finding a competent and honest lawyer with reasonable fees is difficult. The lawyer we had wasn’t too bad, but then he became a judge, so his cases were assigned to his partners. I’m not as happy, but figured it would cost more to change things in mid-process.

You do not need a lawyer in most cases to make out a will and have it legally binding.

♠LoneWerewolf♠ - Good Afternoon. It would be a good idea to use software or some guide to avoid pitfalls though. Not needing a lawyer can save a lot of money but a few simple mistakes need to be avoided! :-)

Wolfie - I just missed you! I was busy on the phone with the lawyer & his secretary. Things were more complicated because my parents sold some farm land, and have been carrying the note. The note is being transferred to me as part of my inheritance, so the trust can be dissolved. But that has been a messy business, so I don’t think a simple will would have done the trick in this case.

♠LoneWerewolf♠ - What you did was a good thing. Someone without any idea of what they’er doing and without any help might make a stupid mistake. A will can be a simple thing and doesn’t need to be much. I have a book of the wills of famous people. It’s amasing what some of them were! (and how simple most of them were also) Congrats for doing it yourself!

When I created a Power of Attorney for my sister (a federal judge), she asked, “You needed a lawyer for this?” Make your own will, just include everything. You know your finances and wishes. A lawyer knows neither.

Hi, Doc! Lew - For Power of Attorney, I think the legal forms works fine. The problem we ran into is because the deed to the property is being held “in escrow” by the bank until the buyer pays off the note to my family. So the legal work needed to be done so I’ll be able to sign the deed when the note is paid off, or that the property will be just mine if the buyer defaults, so I can resell it in that case. If it wasn’t for that piece of property, I think a simple will would have done the trick.
