That is a loophole in the ornithology laws.
Of the four individuals in this story, the Magpie seems the most intelligent.

My neighbors monitor the woodpeckers with a BB gun, but that’s none of my business. I’m just glad my house doesn’t have cedar siding.

I had a northern flicker fly into my sliding glass door several times this morning – I had to chase it away
