    Except for bailing on the Constitution when he had a chance to torpedo Obamacare, he’s been an excellent jurist. This is a reference to Roberts flubbing the oath of office that Barry knew he would never keep anyway at the first inaugural. For tomorrow they’ve already exchanged cards with the oath on it so both of them know what’s coming. Doesn’t matter: Barry won’t uphold it any better the second time than he did the first time.

    It was a bad idea in 1993, and was a bad idea in 2010. I don’t care who proposed it in 1993 or 2010. Anyway, the Democrats had a majority in the House and 60 votes in the Senate in 2010. They could have passed whatever they wanted, and they chose this. This is on them.

    So if Roberts votes to uphold DOMA, does that count as screwing up? After all, he did say that Congress has an almost unlimited ability to tax. At the end of the day, one of the key provisions of DOMA is to shield same-sex couples from the marriage penalty that significantly increases the tax bills of upper income married couples.
