This reminds me of when fans called in to decide the fate of the second Robin Jason Todd.
Whether it’s the emperor in the stands or the gladiator on his phone, there are thumbs involved!
According to one source that I read, us latter day folk got the thumbs up and thumbs down thing backwards.
The “thumbs up” was actually a slashing motion made across the throat – kill him.
The "thumbs down: was a motion of the hand with thumb extended from the right shoulder to the left him meaning “sheath the sword” – spare him.
Most “professional” gladiators were spared. They were expensive property. Slaves and other amateurs usually were eliminated.
I would spare the guy to be honest but we need to let social media take a say

If the vote is “Finish him”, then we need to have another vote to decide how to do him in.
Our society has lost all common sense and rely on a cell to determine outcomes…BOO HISS
In the meantime, I’ll watch this ad about a really cool tactical shovel.
